subcontractors and general contractors can use the Soil Treatment Notice of Non-Payment mobile app with a mobile device to submit a notice of non-payment for the completion of soil treatment work. Use the app to notify the construction project manager, as well as the property owner, that as of the date of the letter, the soil treatment subcontractor has not received final payment. The failure to make payment constitutes a material breach of the soil treatment contract. If within seven days from the date of the letter, the soil treatment subcontractor does not receive final payment of the amount due and owed they will exercise their rights under the contract, which may include termination for material breach. Nothing contained herein shall constitute a waiver of soil treatment subcontractor’s claims for interest on past-due amounts or for interest on past-due amount or for other damages that may result from this breach or the exercise of the of soil treatment subcontractor’s right to terminate the contract. Additional actions, such as a construction lien submitted to the county recorder may result from failure to make payment
