Nursing home facilities must agree to pay the agency. The Florida Nursing Homes Unconditional Guarantee of Payment app outlines an agreement between the two parties. In the app, the guarantor agrees that although the Agency may not have made a final determination of the amount due from the Transferor, all sums due to the Agency resulting from the Fair Rental Value System indexing recapture or depreciation recapture upon change of ownership or from any adjustments that should be made based upon any outstanding audits of cost reports previously submitted by the Transferor are liabilities that are readily ascertainable by the Guarantor 90 days in advance of the transfer and thus included in the Guaranteed Debt. All retro-active rate adjustments now or hereinafter determined to be due are part of the Guaranteed Debt.
