Most collective bargaining agreements include a definition of a grievance, usually in the first paragraph of the grievance procedure. Every contract is different. If the way the company applies a policy or rule does not violate any other contract section, the company may violate the contract’s management rights clause if the company is acting unfairly or unjustly. Although they are not legally required to do so, some unions choose to provide guidance in other circumstances (workers’ compensation, disability or discrimination cases, for example).
